A BILL FOR AN ACT

 

Authorizing the issuance of general obligation bonds and making an appropriation for the glenwood and mountain view areas in hawaii county.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the recent heavy rains and severe flooding that swept across the State caused millions of dollars in damages to homes and businesses. This almost non-stop barrage of rain and the resulting flooding hit the Glenwood and Mountain View areas in the county of Hawaii hardest. These areas are already prone to flooding when it rains, but in light of the recent deluge of rain, the flooding has been severe in these areas. The homes of residents in Glenwood and Mountain View are under constant threat and the potential damage to the Glenwood and Mountain View agricultural industry is significant.

The purpose of this Act is to authorize the issuance of general obligation bonds to assist the county of Hawaii in the planning and design of unspecified flood control measures for the Glenwood and Mountain View areas in Hawaii county.

SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $2,000,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2004-2005 for the purpose of assisting the county of Hawaii in the planning and design of unspecified flood control measures for the Glenwood and Mountain View areas; provided that no funds shall be made available under this Act unless the county of Hawaii provides $2,000,000 for the purposes for which this sum is appropriated.

SECTION 3. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2006, shall lapse as of that date.

SECTION 4. The sum appropriated shall be expended by the county of Hawaii for the purposes of this Act.

SECTION 5. This Act shall take effect on July 1, 2004.
