A BILL FOR AN ACT

 

RELATING TO THE OFFICE OF HAWAIIAN AFFAIRS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 10, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§10-   Termination of the office; transfer of funds and assets. (a) Upon the termination of the office, whether by constitutional or statutory amendment, federal legislation, or court ruling:

(1) All unencumbered and unexpended funds of the office, including but not limited to the balance of moneys in the office of Hawaiian affairs' trust fund for native Hawaiians and the public land trust proceeds trust fund, shall be deposited into the Hawaiian home lands trust fund created under section 213.6 of the Hawaiian Homes Commission Act; and

(2) The real property assets of the office and other tangible assets shall be transferred, including transfer of the right, title, and interest as a matter of law, to the department of Hawaiian home lands.

(b) The intent of this section is to protect the assets of the office and hold them in trust."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
