A BILL FOR AN ACT

 

relating to public property.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 115, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§115-   Penalty. Any person restricting public access to the sea, the shoreline, any inland recreational area, or any public rights-of-way, transit areas, or public transit corridors described in this chapter shall be guilty of a misdemeanor for each violation under this section and, in addition to any other penalties, shall be fined not less than:

(1) $1,000 for each violation that is a second offense; and

(2) $2,000 for each violation that is a third or subsequent offense."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
