A BILL FOR AN ACT
RELATING TO THE HAWAIIAN HOMES COMMISSION ACT, 1920, AS AMENDED.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. (a) Notwithstanding any law to the contrary, the department of hawaiian home lands, may investigate the feasibility of entering into, either alone or in conjunction with any other governmental agency, business relationships as the Hawaiian homes commission deems necessary or appropriate, including but not limited to:
(1) Creating nonprofit corporations to be controlled wholly by the department or jointly with others;
(2) Establishing, subscribing to, and owning stock in business corporations individually or jointly with others; or
(3) Entering into partnerships and other joint venture arrangements, or participating in alliances or other cooperative arrangements, with any public or private
provided that the department and the commission shall not enter into any binding agreements or commitments thereto without legislative approval.
(b) The department of Hawaiian home lands shall develop a program for:
(1) Accepting comments and input from community groups and other stakeholders regarding any business relationships contemplated by the department; and
(2) Legislative oversight on the department's business relationships.
(c) The department of Hawaiian home lands shall report its findings, recommendations, and any proposed legislation to the legislature no later than twenty days prior to the convening of the regular session of 2005.
SECTION 2. This Act shall take effect upon its approval.
