A BILL FOR AN ACT

 

RELATING TO THE MILITIA.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Since the tragic attacks upon the United States on September 11, 2001, the nation has been taking actions to prepare for and protect against additional terrorist attacks upon the United States. The State department of defense has evolved into a joint headquarters. In addition, the Commander of Pacific Command has established a Joint Task Force – Civil Support to respond to potential or actual terrorist threats or attacks on nations throughout the Pacific Rim.

The purpose of this Act is to allow the adjutant general to appoint the deputy adjutant general in the federally recognized grade no higher than major general as the assistant adjutant general of the joint headquarters.

SECTION 2. Section 121-11, Hawaii Revised Statutes, is amended to read as follows:

"§121-11 Deputy adjutant general. The adjutant general may appoint and remove at the adjutant general's pleasure a deputy adjutant general, who shall have a grade no higher than [brigadier.] major general. The deputy adjutant general shall perform duties assigned to the deputy adjutant general by the adjutant general and shall act for and in the place of the adjutant general during the adjutant general's absence or disability."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
