A BILL FOR AN ACT

 

RELATING TO EDUCATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A-   Co-curricular activities of home schooled students. (a) Beginning with the 2003-2004 school year, the department shall allow a home schooled student to participate in any co-curricular activity provided by the public school in the complex in which the home schooled student resides; provided that a home schooled student wishing to participate in a co-curricular activity offered by a public school shall:

(1) Meet the health examination and immunization requirements for admission to a public school;

(2) Meet the academic requirements for participation in co-curricular activities;

(3) Meet the physical requirements for participation in that activity, if any;

(4) Meet the accident insurance requirements for participation in that activity, if any;

(5) Have signed, on the student's behalf by a parent or legal guardian, a waiver absolving the department of liability for personal injury or death, or both;

(6) Pay a reasonable student fee to the department, based on cost, for participation in that activity; and

(7) Have passed the previous grade as determined by applicable content and performance standards.

(b) This section shall apply to middle schools, intermediate schools, and high schools. For the purposes of this section, the term "co-curricular activity" includes athletics, intramurals, band, orchestra, chorus, theatrical productions, and clubs.

(c) The department shall adopt rules in accordance with chapter 91 to carry out the purposes of this section."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
