A BILL FOR AN ACT
relating to public housing residents.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the federal government has required certain public housing residents to perform eight hours of community service a month. Although state public housing residents are able to perform community service at their housing projects, federal public housing residents are inconveniently unable to do so on their housing project's premises because they are managed by private companies that do not allow tenants to do community service on their premises.
The purpose of this Act is to allow all tenants of housing projects to perform their obligation of community service on their housing project premises and makes the State liable for any tenants while performing their community service.
SECTION 2. Chapter 201G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§201G- Tenant community service; liability. (a) The authority shall adopt rules pursuant to chapter 91 to allow all tenants to perform community service duties on the premises of any housing project in the State. Community service duties shall be based on criteria developed by the authority.
(b) The authority shall adopt safety rules and standards relating to the performance of community service by tenants of housing projects on the housing project's premises.
(c) The State shall assume any liability resulting from the tenant's performance of community service on a housing project premises if the tenant has performed in accordance with the safety rules and standards adopted pursuant to subsection (b)."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
