A BILL FOR AN ACT

 

GARNISHMENT ORDERS; EMPLOYER REIMBURSEMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 652-13, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§652-13 Fees and costs.

(a) Every garnishee shall be entitled to reimbursement for administrative fees, which are incurred as a result of complying with a garnishment order. The garnishee shall be entitled to deduct, and retain as an administrative fee, an additional amount of $2, which shall be deducted from the amount owed to the creditor.

(b) This section shall apply only when garnishee has been ordered by the court to withhold a portion of debtor's income based on a valid judgment.

SECTION 2. This act does not affect the rights and duties that matured, the penalties that were incurred, and the proceedings that were begun, before its effective date.

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This act shall take effect upon its approval.
