A BILL FOR AN ACT

 

relating to prescription drugs.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 353C-4.5, Hawaii Revised Statutes, is amended to read as follows:

"[[]§353C-4.5[]] Correctional health care program. (a) There is established a correctional health care program within the department. The administrator of the correctional health care program and physicians who provide care to inmates shall be appointed by the director without regard to [[]chapter 76[]].

(b) The department may purchase from licensed Canadian pharmacies prescription drugs:

(1) Necessary for the maintenance of chronic medical conditions and diseases;

(2) Of a nonperishable nature; and

(3) Equivalent to prescription drugs approved by the United States Food and Drug Administration."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
