A BILL FOR AN ACT

 

relating to transportation.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The department of transportation, in cooperation with the stadium authority and the city and county of Honolulu, shall develop and implement an aloha stadium park and ride pilot project to determine the feasibility of establishing the aloha stadium parking lot or a portion thereof as a permanent park and ride facility.

The department and the city and county shall request formal approval of the usage from the United States Department of the Interior.

The pilot project shall include components that:

(1) Assess and identify the most appropriate location for the aloha stadium park and ride facility site, based on convenience of access to park and ride users and lowest cost to the State;

(2) Provide secure parking for park and ride participants;

(3) Provide free periodic express shuttle bus service from the aloha stadium park and ride facility to downtown Honolulu during peak morning hours;

(4) Provide free periodic express shuttle bus service from downtown Honolulu to the aloha stadium park and ride facility during peak afternoon hours;

(5) Provide a means by which to measure usage, carrying capacity, impact on the easing of regional traffic congestion, and cost for the long term operation of a park and ride facility at the aloha stadium; and

(6) In the opinion of the department of transportation, the stadium authority, or the city and county of Honolulu, are necessary for the success of the pilot project.

SECTION 2. (a) The department of transportation may assess a parking fee against park and ride participants to cover the costs of operating the aloha stadium park and ride pilot project. All revenues derived from the assessment of parking fees shall be deposited in the account established under subsection (c) and shall be used to offset the costs of operating the express shuttle bus service to and from the aloha stadium park and ride facility and downtown Honolulu and any ancillary costs of the pilot project.

(b) For the purposes of the aloha stadium park and ride pilot project, the provisions of section 109-2(2), Hawaii Revised Statutes, relating to the stadium authority's power to prescribe fees, and section 109-3, Hawaii Revised Statutes, relating to the deposit of all funds collected by the stadium authority into the stadium special fund, shall not apply.

(c) The department of transportation shall establish a separate account in the transportation improvement special fund established under section 264-19, Hawaii Revised Statutes, for the purpose of depositing and expending funds to carry out the purposes of the aloha stadium park and ride pilot project. The department of transportation shall not expend any funds from the transportation improvement special fund in excess of what is collected by and deposited to the credit of the aloha stadium park and ride pilot project.

SECTION 3. The department of transportation shall submit a preliminary report on the aloha stadium park and ride pilot project to the legislature not later than twenty days prior to the convening of the 2005 regular session and a final report of its findings and recommendations on whether the pilot project should be made permanent not later than twenty days prior to the convening of the 2006 regular session.

SECTION 3. This Act shall take effect upon its approval

and shall be repealed on July 1, 2006.
