A BILL FOR AN ACT
RELATING TO ANIMALS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 142, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§142- Confinement of dogs. (a) A person who owns or is otherwise in possession or control of a dog shall not:
(1) Leave the dog unattended and confined by a chain, leash, or similar device for more than hours consecutively; or
(2) Confine the dog in a kennel or crate unless there is sufficient room for the dog to stand and turn around.
(b) The department of agriculture shall adopt rules pursuant to chapter 91 to implement this section.
(c) A person who violates this section or the rules adopted pursuant to it shall be fined not more than $100 for the first offense and not less than $100 nor more than $500 for each subsequent offense."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
