A BILL FOR AN ACT

 

relating to school repair and maintenance.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that there exists a poor state of repair in the public schools. While funds are allocated by the legislature each session, the money is not spent in a timely manner on priority projects. A coordinated approach to school repair and maintenance would facilitate the process for the vast number of school repair and maintenance projects and ensure that public school infrastructure is repaired and maintained in a timely manner. Thus, the legislature finds that establishing a chief for school repair and maintenance projects will provide a centralized means to coordinate and complete school repair and maintenance projects that are vital to ensuring quality physical structures for an environment that is conducive to education and learning for Hawaii's school children.

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part VI to be appropriately designated and to read as follows:

"§302A- Chief of school repair and maintenance; established; powers and duties. There is established within the office of the superintendent the position of the chief of school repair and maintenance, which shall be exempt from chapters 76 and 89; provided that the chief shall be entitled to participate in any employee benefit program plan or privilege. The superintendent shall appoint the chief. Effective July 1, 2004, the salary of the chief of school repair and maintenance shall be $     . Notwithstanding any other law to the contrary, the chief shall have entire charge and exclusive control of and be solely responsible for school repair and maintenance and for ensuring completion of school repair and maintenance projects in a timely manner."

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ , or so much thereof as may be necessary for fiscal year 2004-2005, to establish the position the chief of school repair and maintenance.

SECTION 4. The sum appropriated shall be expended by the department of accounting and general services for the purposes of this Act.

SECTION 5. New statutory material is underscored.

SECTION 6. This Act shall take effect upon its approval; provided that sections 3 and 4 shall take effect on July 1, 2004.
