A BILL FOR AN ACT

 

relating to recycling.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 342G, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"PART    . STATEWIDE RECYCLING PROGRAM

§342G-   Mandatory statewide recycling program. (a) Notwithstanding any other law to the contrary, there is established a mandatory statewide recycling program for glass containers, newspaper, office paper, and corrugated cardboard. The program shall be administered by the department.

(b) Each food and beverage establishment in the State shall provide for the separate collection and recycling for glass containers and corrugated cardboard.

(c) Each commercial and industrial building shall provide for the separate collection and recycling for office paper, newspaper, and cardboard.

§342G-   Penalties. Any person who violates any provision of this part, or any rule adopted thereunder, shall be fined not more than $250 for each separate offense. Each day of each violation shall constitute a separate offense. Any action taken to impose or collect the penalty provided for in this section shall be considered a civil action.

§342G-   Rulemaking authority. The department shall adopt rules under chapter 91 to provide for the efficient administration of this part, including but not limited to:

(1) Exemptions for businesses from the mandatory statewide recycling program, as necessary; and

(2) Manner and frequency of recycled material collection."

SECTION 2. This Act shall take effect on January 1, 2005.
