A BILL FOR AN ACT

 

AUTHORIZING ISSUANCE OF GENERAL OBLIGATION BONDS AND MAKING AN APPROPRIATION FOR MANELE SMALL BOAT HARBOR.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the Manele small boat harbor is the major port of entry to Lana`i for residents and visitors alike. The current condition of this harbor has become a tremendous strain on, and danger to, the community. The roads are rocky, rutted, and muddy during rains, and there is no lighting in the area. These conditions have caused damage to vehicles, and the lack of infrastructure creates potentially serious safety issues.

The legislature also finds that a strong harbor and waterfront infrastructure at Manele is critical to the continued growth and prosperity of Hawaii's ocean recreation industry.

To this end, improvements are needed to the Manele small boat harbor to ensure that Hawaii's harbor facilities are able to support ocean recreation and other marine activities.

SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $4,043,538, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2004-2005, for the following Manele small boat harbor improvements:

1. Entry drive $540,588

2. Internal road $2,373,800

3. Parking lot $366,700

4. Turn around/drop off $235,060

5. Landscape (future commercial area) $60,390

6. Design fees and permits $467,000

SECTION 3. The appropriation made for the capital improvement projects authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2007, shall lapse as of that date.

SECTION 4. The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

SECTION 5. This Act shall take effect on July 1, 2004.
