A BILL FOR AN ACT

 

relating to rulemaking.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 23G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§23G-   Review of rules. The office of the legislative reference bureau shall review each rule and rule amendment submitted by a state agency under this section to determine if the rule or amendment violates the substantive authority under which the rule or amendment was adopted. The office shall submit to each regular session of the legislature a report concerning its findings itemizing the agency rules that may be in violation of the substantive authority under which the rule or amendment was adopted. The legislature shall take such action in response to the report as it finds appropriate and shall notify each agency or department whose rule is itemized in the report of the report's findings."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $150,000, or so much thereof as may be necessary for fiscal year 2004-2005, to carry out the purposes of this Act, including the hiring of necessary staff.

SECTION 3. The sum appropriated shall be expended by the legislative reference bureau for the purposes of this Act.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval; provided that section 2 shall take effect on July 1, 2004.
