A BILL FOR AN ACT

 

relating to education.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to provide for compensation of substitute teachers commensurate with educational training and academic qualifications. The current law requires that all substitute teachers be paid at one per diem rate, regardless of their qualifications, without taking into account the completion of a state-approved teacher education program or attainment of a college degree. To address federal mandates under the No Child Left Behind Act of 2001, and local expectations that public schools have highly qualified personnel in all instructional positions, this Act requires the board of education to develop a classification and compensation plan that:

(1) Serves to reward individuals who are highly qualified to promote student learning and achievement; and

(2) Serves as an incentive for others to attain high educational qualifications.

This Act replaces statutory linking of compensation levels to any classification or step of the salary schedule for teachers for several reasons. Substitute teachers are not in the teacher's bargaining unit. Furthermore, the teachers' salary schedule assumes the attainment of a college degree, and the salary schedule is subject to major changes during negotiations, such as renaming of classes and ranges and "shredding," which can render specific statutory references to steps or ranges obsolete and produce other unintended results.

SECTION 2. Section 302A-624, Hawaii Revised Statutes, is amended by amending subsection (e) to read as follows:

"(e) Effective July 1, [1996,] 2004, the per diem rate or rates for substitute teachers shall be [based on the annual entry step salary rate established for a Class II teacher on the most current teachers' salary schedule. The per diem rate shall be derived from the annual rate in accordance with the following formula:

determined by the board based on the classification/compensation plan approved by the board."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2004.
