A BILL FOR AN ACT

 

relating to solid waste.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 342G-1, Hawaii Revised Statutes, is amended by adding three definitions to be appropriately inserted and to read as follows:

""Backhaul" means to ship products, packaging, and all other accommodating materials used for import, back to the place of origin, preferably on the return leg of the shipment.

"Import" means to buy, bring, or accept delivery of goods from an address, supplier, or any entity outside of the State.

"Large retailers and wholesalers" means discount department stores with a floor space of up to two hundred thousand square feet, large specialty retailers with a floor space of up to one hundred twenty thousand square feet, and warehouse clubs with a floor space of up to two hundred thousand square feet."

SECTION 2. Chapter 342G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§342G-   Large retailers and wholesalers; backhaul of packaging and pallets. Large retailers and wholesalers that import goods for commercial sale shall backhaul not less than seventy-five per cent of packaging, crating, insulation, pallets, and all other accommodating materials used for shipping to minimize the amounts to landfill."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2030.
