A BILL FOR AN ACT

 

RELATING TO HIGHWAY SAFETY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the Traffic Code City and County of Honolulu prohibits the transportation of explosives through tunnels. As a consequence, ammunition and explosives that need to be moved between Naval Magazine Pearl Harbor, the Navy's primary ammunition receiving point and storage location on Oahu, and Marine Corps Base Kaneohe are transported either via the North Shore or via Hawaii Kai and Makapuu.

The purpose of this Act is to ensure that military munitions and military explosives can be transported through the H-3 tunnels to minimize the need for their transport through Kamehameha Highway.

SECTION 2. Section 286-222, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

"(b) The department shall annually adopt the hazardous material regulations established by the United States Department of Transportation and published in Title 49, Code of Federal Regulations, Parts 107, 171 to 173, inclusive, and Parts 177, 178, and 180. All other rules adopted by the State and political subdivisions thereof shall be consistent therewith[.]; provided that no ordinance, rule, or other policy shall prohibit military munitions and military explosives from being transported through interstate vehicular tunnels that are a part of the federal Strategic Highway Network."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
