A BILL FOR AN ACT

 

relating to the School-community based management.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The Act that established school/community-based management in public schools, Act 366, Session Laws of Hawaii 1989, stipulated that "the board shall establish a plan and a process whereby all schools will eventually become locally managed beginning with procedures to select those public schools which will participate, at least initially, in making school/community-based management a reality in Hawaii." Unfortunately, that Act did not contain a specific date by which all schools would convert to school/community-based management. The section of Hawaii Revised Statutes that authorizes school/community-based management at the present time, 302A-1124, likewise includes no specific target date for conversion. These omissions are contrary to the intent of the original legislation and prevent to process of conversion from coming to fruition.

There has also been confusion and ambiguity in some situations among certain stakeholders and school/community-based management councils as to the nature of their respective powers and roles. As the public educational system strives to implement school/community-based management, this difficulty should be overcome by ensuring that this process includes a strong training and information component that makes clear to the stakeholders and school/community-based management councils their respective powers and roles.

The purpose of this Act is to establish June 30, 2005, as the date by which all public schools shall initiate school/community-based management, provided that such a management system shall have a training and information component that makes clear to the stakeholders and school/community-based management councils their respective powers and roles.

SECTION 2. Section 302A-1124, Hawaii Revised Statutes, is amended to read as follows:

"[[]§302A-1124[]] Mandate to initiate school/community-based management system. The department, through the board and its superintendent, shall formulate policies, including criteria and procedures to determine [which] how schools and learning support centers shall participate in the system, to initiate a school/community-based management system in [the] all public schools[.] by June 30, 2005; provided that such a system shall have a training and information component that makes clear to the stakeholders and school/community-based management councils their respective powers and roles."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
