A BILL FOR AN ACT

 

relating to School work-study.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A-   School work-study special fund. (a) There is established in the department a program to provide students with paid work experience and employers with reliable entry-level workers.

First priority for participation in the school work-study program shall be given to students with a disability who are eligible for post-secondary transition services, regardless of grade level. Second priority shall be given to students who are pursuing specific programs of study at learning centers, regardless of grade level. Third priority shall be given to students in the twelfth grade. Fourth priority shall be given to students in the eleventh grade. Fifth priority shall be given to students in the tenth grade.

(b) All wages paid to students participating in the school work-study program established by this section shall become realizations of their respective schools and deposited to the credit of the school work-study special fund established under subsection (c). To provide school work-study experiences for the greatest number of students possible, job sharing arrangements shall be encouraged whenever possible.

Section 302A-430 shall apply to the school work-study program to the same extent that it applies to the work-based learning program authorized under section 302A-429. Subject to the limitations in subsection (c)(1) and (2), the superintendent may expand the school work-study program established under this section with the work-based learning program authorized under section 302A-429 if such a merger would be advantageous to both programs.

(c) There is established in the state treasury a fund to be known as the school work-study special fund, into which shall be deposited all moneys derived from school work-study business ventures and related learning opportunities, including wages paid to participating students. The director of finance shall establish separate accounts within the special fund to facilitate the management of each school's moneys, which shall not be commingled with moneys in other funds or with other schools' moneys. Moneys in the special fund shall be appropriated for the purposes of, and shall be expended by each school for:

(1) The operation of school work-study business ventures and other learning opportunities that provide students with paid work experience and employers with reliable entry-level workers; and

(2) The operation of necessary student-employer support programs, including programs for the supervision, screening, training, and transportation of student-workers, and the monitoring of their employers.

(d) Notwithstanding subsection (c) to the contrary, the director of finance shall transfer from each account within the special fund to the state general fund, any amount over $        . The director of finance shall complete the transfer of these excess moneys from an account within the special fund to the state general fund not less than twenty days after the end of the fiscal year. This subsection shall not be construed to exempt the special fund or any account from the requirements of sections 36-27 and 36-30."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2004.
