A BILL FOR AN ACT

 

RELATING TO REpeated excessive speeding of a VEHICLE.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§291C- Excessive Speeding; Habitual Offender.

(a) Whoever operates any vehicle, within the state of Hawaii, more than 20 miles per hour over the posted speed limit, on two separate occasions in a three-year period shall be deemed a habitual offender.

(b) The examiner of drivers shall revoke the driver's license of any resident of this state found to be a habitual offender.

(1) For purposes of this section, a "habitual offender" is defined as any person whose driving record shows two convictions for exceeding the posted speed limit by 20 miles per hour in a three-year period.

(c) The operating privilege of any person found to be a habitual offender shall be revoked by the examiner of drivers for a period of one year.

(d) Any person found driving after being classified as a habitual offender under this section shall be subject to penalties under §286-132.

SECTION 2. This act does not affect the rights and duties that matured, the penalties that were incurred, and the proceedings that were begun, before its effective date.

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This act shall take effect upon its approval.
