A BILL FOR AN ACT

 

relating to herbicide use.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 264, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§264- Herbicide use notification on public highways and trails. No public highway or trail, including their surrounding areas, shall undergo herbicide use unless the department of transportation or other responsible agency posts signs indicating the date, time, and location of the herbicidal use. The signs shall be posted at least three weeks in advance of the use and remain for at least three weeks after, or as long as the herbicide use poses adverse effects on public health and the environment, whichever is longer."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
