A BILL FOR AN ACT

 

RELATING TO CREDIT CARD FRAUD.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 476, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§476-   Credit card and debit card account numbers. (a) No provider may print or otherwise produce or reproduce or permit the printing or other production or reproduction, on any receipt provided or made available to the credit buyer, of:

(1) Any part of the credit card or debit card account number, other than the last four digits or other characters; and

(2) The credit card or debit card expiration date.

(b) This section shall not apply to receipts issued for transactions on electronic benefits transfer card system under 7 CFR 274.12.

(c) A provider violating this section shall be guilty of a misdemeanor and upon conviction shall cease the practice prohibited by this section.

(d) As used in this section, "provider" means a person or entity who furnishes money, goods, services, or anything of value upon presentation, whether physically, in writing, verbally, electronically, or otherwise, of a credit card or debit card by the credit buyer or any agent or employee of that person."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on January 1, 2005.
