A BILL FOR AN ACT

 

relating to health insurance reimbursements.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 431, Hawaii Revised Statutes, is amended by adding a new section to article 10A to be appropriately designated and to read as follows:

"§431:10A-   Direct reimbursement to non-participating providers. (a) Each insurer issuing a policy under this chapter shall reimburse directly to a non-participating provider of a covered service under this chapter; provided that the amount of reimbursement may be at a lower rate; and provided further that the reimbursement check may be issued jointly to the insured and the non-participating provider.

(b) Subsection (a) shall apply to a non-participating provider who is duly licensed in this State and who meets the credentialing requirements of the policy."

SECTION 2. Chapter 432, Hawaii Revised Statutes, is amended by adding a new section to article 1 to be appropriately designated and to read as follows:

"§432:1-   Direct reimbursement to non-participating providers. (a) Each insurer issuing a policy under this chapter shall reimburse directly to a non-participating provider of a covered service under this chapter; provided that the amount of reimbursement may be at a lower rate; and provided further that the reimbursement check may be issued jointly to the insured and the non-participating provider.

(b) Subsection (a) shall apply to a non-participating provider who is duly licensed in this State and who meets the credentialing requirements of the policy."

SECTION 3. Chapter 432D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§432D-   Direct reimbursement to non-participating providers. (a) Each insurer issuing a policy under this chapter shall reimburse directly to a non-participating provider of a covered service under this chapter; provided that the amount of reimbursement may be at a lower rate; and provided further that the reimbursement check may be issued jointly to the insured and the non-participating provider.

(b) Subsection (a) shall apply to a non-participating provider who is duly licensed in this State and who meets the credentialing requirements of the policy."

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2004.
