A BILL FOR AN ACT
RELATING TO PUBLIC SCHOOLS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§302A- Public schools; minimum school calendar. (a) Beginning with the 2004-2005 school year, all public schools shall implement a school calendar that provides not less than one hundred eighty days per school year of classroom instruction delivered by teachers or substitute teaching staff. The minimum school calendar shall not include state holidays provided by law, professional development days, or other non-student days negotiated pursuant to chapter 89.
(b) Notwithstanding the provisions of section 89-9, the board of education shall require that the school-level educational officer and school-level teacher work years provide a minimum one hundred eighty days per school year of classroom instruction; provided that additional work days beyond one hundred eighty days shall be compensated at a rate negotiated pursuant to chapter 89.
(c) For the purposes of this section, "classroom instruction" includes face-to-face teacher-student interaction within a work day for the purposes of delivering educational and related services, including student assessments and remedial services, and does not include extra-curricular programs not required for student promotion pursuant to statewide educational policies adopted by the board of education."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
