A BILL FOR AN ACT

 

relating to the hawaii right to farm act.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 165, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§165- Nonrestrictive use of agricultural lands. Agricultural uses shall not be restricted by any servitudes, including but not limited to, covenants, easements, or equitable and reciprocal negative servitudes placed on any lands classified as agricultural by existing law or by determination of the land use commission. Any such private restriction limiting or prohibiting agricultural uses shall be void."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
