A BILL FOR AN ACT

 

RELATING TO FIREWORKS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. In keeping with the home rule principle, the legislature feels that the respective counties should be the authority to regulate fireworks in their jurisdiction.

SECTION 2. Chapter 132, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§132- Authority of the Counties to regulate Fireworks. The respective counties of the State are directed to formulate ordinances to regulate the sale, use, and storage of fireworks."

SECTION 3. Chapter 132D, Hawaii Revised Statutes, is repealed.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2004.
