A BILL FOR AN ACT

 

MAKING AN EMERGENCY APPROPRIATION FOR THE DEPARTMENT OF HEALTH, HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPAA) COMPLIANCE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. This Act is recommended by the governor for immediate passage in accordance with section 9 of article VII of the Constitution of the State of Hawaii.

SECTION 2. This emergency appropriation is necessary to comply with the federal Health Insurance Portability and Accountability Act of 1996.

The purpose of this Act is to appropriate an additional $1,292,439 in general funds for fiscal year 2002-2003 to pay for start-up and remediation costs to comply with the federal Health Insurance Portability and Accountability Act of 1996.

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,292,439 or so much thereof as may be necessary for fiscal year 2002-2003 to comply with the federal Health Insurance Portability and Accountability Act of 1996.

SECTION 4. The sum appropriated shall be expended by the department of health for the purposes of this Act.

SECTION 5. This Act shall take effect upon its approval.
