A BILL FOR AN ACT

 

RELATING TO EDUCATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that extracurricular and co-curricular activities, including but not limited to competitive interscholastic sports, academic teams and clubs at the public schools are important as a complement to the development of social and intellectual skills necessary to become a well-rounded adult.

The purpose of this Act is to allow home-schooled students to participate in extracurricular and co-curricular activities of the public school to which the home-schooled student would be assigned, in accordance with the department of education's school attendance area policies.

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A- Home-schooled students; participation in extracurricular and co-curricular activities. (a) Beginning with the 2004-2005 school year, a home-schooled student shall be eligible to apply to participate in extracurricular and co-curricular activities at the public school within the school complex to which the student would be assigned by the department. The home-schooled student may not be granted a geographic exception for this purpose.

(b) Eligibility and participation requirements for home-schooled students in extracurricular and co-curricular activities of their assigned public school shall be determined by rules to be adopted by the department under chapter 91. A public school may charge a fee for participation by home-schooled students in extracurricular and co-curricular activities, if the public school's students are also required to pay a participation fee. The fee for participation by a home-schooled student shall be the same as the fee charged a public school student; provided that if any fee is collected pursuant to this subsection, the fee shall be used for expenses of the particular activity for which it is charged and not for any other purpose.

(c) The department shall not be responsible for transportation of the home-schooled student from the student's home to the site of the extracurricular and co-curricular activity and from the site to the student's home. The State shall not be liable for any incident occurring or injuries sustained by the home-schooled student during the period of time the student is in transit to the site of the extracurricular or co-curricular activity and from the site to the student's home.

(d) The department may adopt rules pursuant to chapter 91 necessary for the purposes of this section."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
