A BILL FOR AN ACT

 

RELATING TO INSURANCE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 432D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§432D- Foreign health maintenance organization; certification. (a) Notwithstanding section 432D-2 or any law to the contrary, the commissioner may waive the filing of any information required to be filed under section 432D-2(c) by a foreign corporation authorized to do business in another state; provided that filing shall not be waived for information pertaining to requirements for a certificate of authority imposed by this state that are in addition to those of the state or states in which the corporation is authorized to do business.

(b) Nothing in this section shall limit the commissioner's authority to require a foreign health maintenance organization to proceed with the certification process under this article if the commissioner, in the commissioner's discretion, determines that it would be in the public interest."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
