A BILL FOR AN ACT

 

relating to energy.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 269, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§269-A Transmission; sources. Each franchised or certificated electric utility company operating in the State of Hawaii shall transport power upon request of any individual. The utility company shall file for approval by the Commission a special tariff containing the rules, conditions of service, and rates for the wheeling of power, which rates shall be based on the costs of that particular utility company, which costs shall be disclosed to the Commission. The initial costs of interconnection with the utility transmission system at the point of generation, and the point of consumption, shall not be borne by the utility company. The generator of the power and the consumer of the power need not be the same individual.

For purposes of this section, "wheeling" means the transportation of electricity to consumers from power sources via transmission lines owned by utilities."

SECTION 2. In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
