A BILL FOR AN ACT

 

RELATING TO ETHICS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Certain elected officials, including the governor, lieutenant governor, mayors, and county council members, take office at a set period after they are elected to office. However, these elected officials often take official actions before they actually take office. The purpose of this Act is to clarify that these officials come under the jurisdiction of the ethics commission as soon as they are elected, not on the later date when they actually take office.

SECTION 2. Chapter 84, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§84- Ethics commission, jurisdiction. An elected official who is a legislator or an employee under this chapter shall come under the jurisdiction of the commission as soon as the official has been elected, and not at the point when the official takes office."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2003.
