A BILL FOR AN ACT

 

RELATING TO EXECUTIVE communications.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Findings and purpose. The legislature finds that the constitutionally granted executive powers of the governor may be implemented through executive orders. In addition, the governor issues proclamations and executive messages to the legislature.

The legislature further finds that the public should have timely notice of and access to these documents, and that they should be placed in a public location, including the Internet, within a short time after their issuance.

The purpose of this Act is to recognize executive orders in the statutes and provide for public notice of, and access to:

(1) Executive orders;

(2) Gubernatorial proclamations; and

(3) Executive messages to the legislature.

SECTION 2. Chapter 26, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§26- Executive communications; notice and publication. The public shall be provided with notice of every:

(1) Executive order;

(2) Gubernatorial proclamation; and

(3) Executive message to the legislature

within five days of its issuance, by statewide publication as provided by section 1-28.5. The notice shall set forth, at a minimum, a list of each document's title and a concise summary of its contents. Each executive order, gubernatorial proclamation, and executive message to the legislature shall also be made available in hard copy and on the Internet within the same time period."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2004.
