A BILL FOR AN ACT

 

relating to liability.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 663, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§663- Hospital helicopter landing pads; exception to liability. No hospital that operates a helicopter landing pad, whether on or off the premises of that facility, for use by medical evacuation helicopters or other helicopter medical transport services, shall be held liable for any civil damages resulting from any act or omission, except for such damages as may result from the hospital's gross negligence or wanton acts or omissions."

SECTION 2. This Act shall apply only to causes of action based upon acts or omissions occurring on or after its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
