HOUSE CONCURRENT

RESOLUTION

 

REQUESTING THE GOVERNOR TO COMPLY WITH THE STATUTORY DIRECTIVE THAT THE DEPARTMENT OF BUSINESS, ECONOMIC DEVELOPMENT, AND TOURISM HAve SOLE JURISDICTION OVER THE LAND USE COMMISSION, OFFICE OF PLANNING, AND THE HAWAII STATE PLANNING ACT.

 

 

WHEREAS, the Constitution of the State of Hawaii gives the Legislature express authority to allocate executive and administrative offices within no more than twenty principal executive departments; and

WHEREAS, the Legislature has enacted laws over the years to group executive and administrative offices according to common purposes and related functions; and

WHEREAS, Hawaii Revised Statutes specifically establishes the Office of Planning (OP) within the Department of Business, Economic Development, and Tourism (DBEDT) and provides that OP shall assist DBEDT in maintaining an overall framework to guide the development of the State; and

WHEREAS, among its duties, OP prepares the guidelines for the State Functional Plans and provides recommendations to the Governor and state and county agencies on conflicts between the Functional Plans, the Hawaii State Planning Act, state programs, and county plans; and

WHEREAS, the power to direct OP to report to a principal department other than to DBEDT rests solely with the Legislature; and

WHEREAS, DBEDT maintains sole jurisdiction over land and state planning functions; and

WHEREAS, OP reports to DBEDT; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-second Legislature of the State of Hawaii, Regular Session of 2004, the Senate concurring, that the Legislature requests the Governor to comply with the statutory directive that the Department of Business, Economic Development, and Tourism have sole jurisdiction over the Land Use Commission, Office of Planning, and the Hawaii State Planning Act, including specifically, that the Office of Planning shall not report to any other principal executive department other than the Department of Business, Economic Development, and Tourism; and

BE IT FURTHER RESOLVED that the Governor is requested to submit a report to the Legislature not later than 20 days before the convening of the Regular Session of 2005 on actions taken to comply with this Concurrent Resolution; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, Director of the Department of Business, Economic Development, and Tourism, Director of the Office of Planning, and the Executive Officer of the Land Use Commission.
