RESOLUTION
requesting the Department of Health TO CONVENE A TASK FORCE to IDENTIFY ISSUES AND SOLUTIONS to ALLOW private pay patients to receive day continuing services, INCLUDING MENTAL HEALTH TREATMENT, PSYCHOSOCIAL REHABILITATION SERVICES, AND OTHER COMMUNITY SUPPORT.
WHEREAS, the Director of Health (Director) is authorized under section 334-6(a), Hawaii Revised Statutes (HRS), to establish reasonable charges for psychiatric treatment services under chapter 334, HRS, relating to mental health, illness, and addiction; and
WHEREAS, according to the Department of Health (DOH), a severely mentally ill adult without insurance who meets DOH's Adult Mental Health Division's (AMHD) eligibility criteria can receive services from DOH, and the Director can waive the requirement for payment in instances of financial hardship; and
WHEREAS, there exists a gap group of individuals who currently do not have or require active case management through AMHD and who are receiving psychiatric services from private providers, but would prefer to receive services from DOH; and
WHEREAS, if these "private pay" individuals are provided with services by DOH instead of by private providers, it would only be fair that DOH charge reasonable fees for its services for the gap group; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-second Legislature of the State of Hawaii, Regular Session of 2004, the Senate concurring, that DOH is requested to convene a Task Force to identify issues and solutions to allow private pay patients to receive day continuing services; and
BE IT FURTHER RESOLVED that in identifying issues and solutions, the Task Force:
(1) Identify statutes, rules, policies, and directives that need revision to allow DOH to provide private pay patients with continuing services;
(2) Address the issue of appropriate fees and graduated fee schedules for private pay patients who receive day continuing services, including mental health treatment, psychosocial rehabilitation services, and other community support through DOH;
(3) Address the procedures, rules, regulations, restrictions, and requirements of DOH mental health facilities and service providers that may prohibit or inhibit the delivery of day services to private pay patients; and
(4) Identify information, data, and analyses that assess the need for day continuing services and use of mental health, psychosocial rehabilitation, and community support services by persons that are currently private pay;
and
BE IT FURTHER RESOLVED that the Task Force include but not be limited to representatives from the following agencies, organizations, or affiliations:
(1) DOH, Adult Mental Health Division;
(2) The Department of Human Services;
(3) The Healthcare Association of Hawaii;
(4) Community Care Services;
(5) The Hawaii Medical Service Association;
(6) Kaiser Permanente; and
(7) The National Alliance for the Mentally Ill of Oahu;
and
BE IT FURTHER RESOLVED that the Task Force is requested to submit its findings and recommendations, including any proposed legislation, to the Legislature no later than 20 days prior to the convening of the Regular Session of 2005; and
BE IT FURTHER RESOLVED that DOH is requested to consider the use of the following definitions:
(1) "Continuing services" means services provided by the Department of Health and voluntarily requested by the private pay patient that are designed to promote recovery from severe and persistent mental illness through treatment, psychosocial rehabilitation services, and other community support, based on the understanding that severe and persistent mental illness is generally life-long, with an individualized course of recovery that may include relapse and remission"; and
(2) "Private pay patient" means a person who:
(A) Is otherwise eligible, as assessed by the Department of Health, to receive day continuing services;
(B) Requests to receive those services voluntarily; and
(C) Is able to and does pay in full, any graduated charges to be established and imposed by the Director of Health for the provision of these services";
and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Health, Director of Human Services, President of Healthcare Association
of Hawaii, President of Community Care Services, President of Hawaii Medical Services Association, President of Kaiser Permanente, and President of National Alliance for the Mental Ill of Oahu.
