A BILL FOR AN ACT
relating to the obstruction of an ingress or egress.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that section 852-2, Hawaii Revised Statutes (HRS), is inconsistent with public policy to treat all members of the public in a similar manner for the offense of obstructing ingress or egress on public and private property. Section 852-2, HRS, imposes a greater penalty on restricting ingress or egress on private property as compared to restricting ingress or egress on public property. The legislature further finds that amending section 852-2, HRS, serves the public interest in that the same offense should be treated with similar penalties. This also avoids disparate treatment because of an individual's political or organizational affiliation.
The purpose of this Act is to amend section 852-2, HRS, to:
(1) Provide for a penalty applicable to members of labor organizations that is similar to that contained in section 711-1105, HRS;
(2) Eliminate the possibility of imprisonment that currently exists; and
(3) Change the status of a conviction under section 852-2, HRS, from a petty misdemeanor to a violation.
SECTION 2. Section 852-2, HRS, is amended to read as follows:
"§852-2 Penalty. [Any person who refuses or wilfully fails to move as directed by such officer shall be fined not more than $200 or imprisoned not more than six months, or both.] Any person who refuses or wilfully fails to move as directed by such officer shall be fined not more than $200."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
