A BILL FOR AN ACT

 

RELATING TO MOTOR VEHICLE INSURANCE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 431:10C-207, Hawaii Revised Statutes, is amended to read as follows:

"§431:10C-207 Discriminatory practices prohibited. No insurer shall base any standard or rating plan, in whole or in part, directly or indirectly, upon a person's race, creed, ethnic extraction, age, sex, length of driving experience, credit bureau rating, marital status, or physical handicap[.]; provided that an insurer shall base a favorable standard or rating plan upon the fact that a person is fifteen years of age or older and under nineteen years of age, and has received a certificate of completion of the course in driver education and training offered by the department of education under section 302A-413 or certified pursuant to section 286-108.4."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
