A BILL FOR AN ACT

 

RELATING TO EXECUTIVE communications.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Findings and purpose. The legislature finds that the constitutionally granted executive powers of the governor may be implemented through what is known as executive orders, for which there is no provision in statute. In addition, the governor is known to also issue proclamations, as well as executive messages to the legislature.

The legislature further finds that the public has a right to have access to these documents, and that to increase their availability they should be placed in a public location, including on the Internet, within a short time after their issuance.

The purpose of this Act is to establish statutory provisions that recognize executive orders and provides for public notice requirements for executive orders, proclamations, and executive messages to the legislature.

SECTION 2. Chapter 26, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§26- Executive communications and other gubernatorial issuances, availability. Notice of every executive order, gubernatorial proclamation, and executive message to the legislature shall be made to the public within five days of its issuance by publication in a newspaper of general circulation in the State or in another manner designed to reach the general public. Each executive order, gubernatorial proclamation, and executive message to the legislature also shall be made available in hard copy and on the Internet within the same time period."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2003.
