A BILL FOR AN ACT

 

relating to adult residential care homes.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that adult residential care homes which include community care foster family homes, provide a valuable, cost-effective nursing care option for Hawaii's elderly, and that there is a need to encourage, enhance, and support the continuation and development of community-based nursing care facilities in Hawaii.

Act 273, Session Laws of Hawaii (SLH) 2001, provided for the certification of community care foster family homes by home-and community-based case management agencies licensed by the department of human services. Act 273, SLH 2001, is scheduled to be repealed on June 30, 2003. However, the legislature believes that further study is required on this service, which has proved to be useful during a time when Hawaii is faced with a long-term care crisis.

The purpose of this Act is to continue to provide for the licensing of home- and community-based case management agencies and regulation of community care foster family homes by extending the repeal date of Act 273, SLH 2001, to June 30, 2005. In addition, this Act requires the department of human services to report to the legislature regarding the certification of community care foster family homes, as well as the possibility of integrating or consolidating the classification of community care foster family homes with adult residential care homes.

SECTION 2. Act 273, Session Laws of Hawaii 2001, is amended by amending section 6 to read as follows:

"SECTION 6. This Act shall take effect on July 1, 2001, and shall be repealed on June 30, [2003.] 2005."

SECTION 3. The department of human services shall submit a report to the legislature no later than twenty days prior to the regular session of 2005 detailing the cost-effectiveness and administration of the process of certifying community care foster family homes, as well as the possibility of integrating or consolidating the classification of community care foster family homes with adult residential care homes as defined in section 321-15.1, Hawaii Revised Statutes.

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2010.
