A BILL FOR AN ACT

 

relating to the shoreline.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 200-1, Hawaii Revised Statutes, is amended by amending the definition of "shoreline" to read as follows:

""Shoreline" [means the upper reaches of the wash of the waves, usually evidenced by the edge of vegetation growth or by the upper limit of debris left by the wash of the waves.] has the same meaning as defined in section 205A-1."

SECTION 2. Section 205A-1, Hawaii Revised Statutes, is amended by amending the definition of "shoreline" to read as follows:

""Shoreline" means the upper reaches of the wash of the waves, other than storm and seismic waves, at high tide during the season of the year in which the highest wash of the waves occurs, usually evidenced by the edge of vegetation growth, or the upper limit of debris left by the wash of the waves[.], whichever is farthest inland."

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
