A BILL FOR AN ACT
relating to insurers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 431, Hawaii Revised Statutes, is amended by adding a new section to part II of article 3 to be appropriately designated and to read as follows:
"§431:3- Claims service; office or agent in State required; penalty. (a) Every insurer shall establish and maintain a complete claims service office or engage an independent adjusting service as its claims agent in the State for the investigation, processing, and payment of property, motor vehicle, and general casualty insurance claims.
(b) Failure to comply with subsection (a) shall subject an insurer to penalties as provided by section 431:2-203.
(c) Nothing in this section shall preclude reporting to, supervision, or reviewing by non-domiciled personnel."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2050.
