A BILL FOR AN ACT

 

RELATING TO RULES OF COURT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 607-1, Hawaii Revised Statutes, is amended to read as follows:

"§607-1 Power of supreme court with respect to costs and fees. The supreme court shall have power by rule of court, from time to time, to revise, amend, add to, or eliminate any of the items of costs and fees provided in this chapter, to prescribe such costs and fees as it deems reasonable in all cases not therein provided for, and to prescribe the amount to be paid in advance to the clerk of any court in any proceeding on account of the costs and fees. Any fees prescribed by supreme court rule for the electronic filing, signing, serving, certification, and verification of documents shall be deposited into the judiciary computer system special fund."

SECTION 2. Section 607-2, Hawaii Revised Statutes, is amended to read as follows:

"§607-2 Fees to be accounted for. With the exception of fees prescribed by supreme court rule for electronic filing, signing, serving, certification, and verification of documents, which shall be deposited into the judiciary computer system special fund, and such fees as are intended to reimburse officers for actual expenditures made by them, all judges', clerks', sheriffs', and deputy sheriffs' fees provided for in this chapter and accruing from any action pending in any court shall be deposited to the credit of the general fund of the State."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
