A BILL FOR AN ACT

 

RELATING TO THE HOUSING AND COMMUNITY DEVELOPMENT CORPORATION BOARD.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 201G-3, Hawaii Revised Statutes, is amended as follows:

1. By amending subsection (a) to read:

"(a) There is created a board consisting of [nine] thirteen members, of whom [six] eleven shall be public members appointed by the governor as provided in section 26-34. Public members shall be appointed [from each of the counties of Honolulu, Hawaii, Maui, and Kauai.] as follows:

(1) One public member shall be the chairperson of the rental housing trust fund advisory commission [. At least one];

(2) One public member shall be a person who is directly assisted by the corporation under the federal low-rent public housing or federal section 8 tenant-based housing assistance payments program while serving on the board[.];

(3) One public member shall be a representative of the Honolulu Board of Realtors;

(4) One public member shall be a representative of Maui Board of Realtors;

(5) One public member shall be a representative of the Kauai Board of Realtors;

(6) One public member shall be a representative of the Big Island Board of Realtors;

(7) One public member shall be a representative of the Institute of Real Estate Management;

(8) One public member shall be a representative of the National Association of Industrial and Office Properties;

(9) One public member shall be a member of the Appraisal Institute;

(10) One public member shall be a representative of the Banker's Association; and

(11) One public member shall be a representative of the Contractor's Association.

The public members of the board shall serve four-year staggered terms; provided that the initial appointments shall be as follows: [two] four members to be appointed for four years; [two] three members to be appointed for three years; and [one member] three members to be appointed for two years. The chairperson of the rental housing trust fund advisory commission shall serve a concurrent term on the board. The director of business, economic development, and tourism and the director of human services, or their designated representatives, [and a representative of the governor's office,] shall be ex officio voting members. The corporation shall be headed by the board."

2. By amending subsection (c) to read:

"(c) [Five] Seven members shall constitute a quorum, whose affirmative vote shall be necessary for all actions by the corporation. The members shall receive no compensation for services, but shall be entitled to necessary expenses, including travel expenses, incurred in the performance of their duties."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
