A BILL FOR AN ACT

 

RELATING TO THE HOUSING AND COMMUNITY DEVELOPMENT CORPORATION OF HAWAII.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The United States Department of Housing and Urban Development found that the housing and community development corporation of Hawaii is not implementing federal public housing laws and regulations for public housing and rental assistance in a timely manner. The continued delay in implementation could result in the loss of federal funds for public housing programs, including the federal low-rent public housing program and the section 8 housing choice voucher program.

The legislature has determined that a primary reason for the delay in implementing federal public housing laws and regulations is the protracted administrative rulemaking process pursuant to chapter 91, Hawaii Revised Statutes. The purpose of this Act is to authorize the housing and community development corporation of Hawaii to promulgate administrative rules for federal public housing programs without regard to chapter 91 while providing for public input.

SECTION 2. Chapter 201G, Hawaii Revised Statutes, is amended by adding to part I a new section to be appropriately designated and to read as follows:

"§201G- Administration of federal public housing programs. (a) The corporation may carry out federal programs designated to be carried out by a public housing agency. The corporation may adopt necessary rules, including the establishment and collection of reasonable fees for administering the public housing programs. Rules shall be adopted without regard to chapter 91 and shall be approved by the governor and take effect immediately upon filing with the office of the lieutenant governor. Rulemaking shall be adopted by the board and shall minimally provide for an open meeting that permits the attendance of any interested persons.

(b) All fees collected for administering the program may be deposited into an appropriate special fund of the corporation and may be used to cover the administrative expenses of the corporation."

SECTION 3. Section 201G-15, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) The corporation may carry out federal programs designated to be carried out by a housing finance entity, housing development entity, [public housing agency,] or entity designated by the corporation."

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
