A BILL FOR AN ACT

 

relating to boating.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

"§200-   Evaporative and exhaust emissions; standards. The department shall adopt rules, including administrative penalties, establishing and enforcing evaporative emissions standards and exhaust emissions standards for marine vessels that use spark-ignition engines, including sterndrive, inboard, and outboard engines and personal watercraft.

For the purposes of this section, the term "personal watercraft" includes a jet ski, waverunner, wet bike, surf jet, miniature speed boat, hovercraft, and every description of vessel that uses an internal combustion engine powering a water jet pump as its primary source of motive propulsion."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $        , or so much thereof as may be necessary for fiscal year 2003-2004, and the same sum, or so much thereof as may be necessary for fiscal year 2004-2005, to carry out the purposes of this Act.

SECTION 3. The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2003.
