A BILL FOR AN ACT

 

Proposing an amendment to article VIII, section 1, of the constitution of the state of hawaii to allow counties to create political subdivisions.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to propose an amendment to article VIII, section 1, of the Constitution of the State of Hawaii to allow counties to create political subdivisions.

SECTION 2. Article VIII, section 1, of the Constitution of the State of Hawaii is amended to read as follows:

"CREATION; POWERS OF POLITICAL SUBDIVISIONS

Section 1. The legislature shall create counties, and may create other political subdivisions within the State, and provide for the government thereof. Counties may create political subdivisions within their boundaries by ordinance or charter amendment. Each political subdivision shall have and exercise such powers as shall be conferred under general laws."

SECTION 3. The question to be printed on the ballot shall be as follows:

"Shall the counties be allowed to create political subdivisions within their boundaries by ordinance or charter amendment?"

SECTION 4. New constitutional material is underscored.

SECTION 5. This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
