A BILL FOR AN ACT

 

relating to feasibility of cellular telephone transmission and reception beyond keeau beach park.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that there is no land-line telephone service to serve the general public in the area beyond Keaau beach park on the leeward coast of Oahu. In the past, residents and visitors alike have attempted to use cellular telephones during emergencies to summon assistance, but to no avail. Although cellular telephone service has spread and is becoming quite common in the State, there are certain remote areas of the State where cellular transmission and reception are not currently being provided because cellular telephone operators have not provided adequate coverage.

The purpose of this Act is to require the State to determine, in the public interest, if it is feasible to erect a repeater station to provide cellular telephone transmission and reception service to the general public in the area beyond Keeau beach park.

SECTION 2. (a) The department of accounting and general services shall consult with the department of land and natural resources, the public utilities commission, any other state agency, and the city and county of Honolulu, if necessary, to determine the feasibility of providing cellular telephone transmission and reception service to the general public in the area beyond Keaau beach park on the leeward coast of Oahu. The department of accounting and general services shall include the following in its determination:

(1) The feasibility of erecting a repeater station at an appropriate site;

(2) An optimal site for a repeater station, with alternative sites, based on availability and use of land;

(3) Projected cost of constructing a repeater station, including plans, design, construction, and possible acquisition of land, for each alternative site.

(b) The department shall report its findings and recommendations to the governor and the legislature no later than twenty days prior to the convening of the regular session of 2004.

SECTION 3. This Act shall take effect upon its approval.
