A BILL FOR AN ACT

 

relating to stream erosion.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that without erosion controls, rains and flooding can cause major damage to property and threaten the public safety. The legislature further finds that erosion of the banks of the Kawa stream in the Pikoiloa tract of Kaneohe, Oahu, poses a threat to the public health and to the safety and security of the residents and properties along the stream. Although Kawa stream is prone to flooding and erosion, only portions of the stream banks have been lined with concrete. The legislature further finds that prudence and public safety warrant an erosion control study of the banks of Kawa stream.

The purpose of this Act is to appropriate funds to conduct an erosion control study of Kawa stream to prevent further erosion.

SECTION 2. The department of land and natural resources shall conduct an erosion control study of Kawa stream to prevent further erosion. The study shall include the identification of applicable federal and state funding sources to undertake and complete repairs and renovation of the banks of Kawa stream to prevent further erosion. The department of land and natural resources shall submit the findings and recommendations to the legislature no later than June 30, 2004.

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $      or so much thereof as may be necessary for fiscal year 2003-2004 to conduct an erosion control study of Kawa stream to prevent further erosion.

The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

SECTION 4. This Act shall take effect on July 1, 2003.
