A BILL FOR AN ACT

 

relating to hepatitis b immunization.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 302A-1154, Hawaii Revised Statutes, is amended to read as follows:

"§302A-1154 Immunization upon entering school; tuberculosis clearance. (a) No child shall attend any school in the State unless the child presents to the appropriate school official documentation satisfactory to the department of health that the child has received immunizations against communicable diseases as required by the department of health[.] pursuant to section 325-32.

(b) No child shall be admitted to attend any school for the first time in the State unless the child presents to the appropriate school official documentation satisfactory to the department of health that the child has been examined and tested according to the rules of the department, and is free from tuberculosis in a communicable form.

(c) For each school year beginning after July 1, 2004, no child shall be admitted to attend any school in the seventh grade unless the child presents to the appropriate school official documentation satisfactory to the department of health that the child has been fully immunized against hepatitis B; provided that a child who has not been fully immunized against the hepatitis B virus may be admitted to the seventh grade if the child provides documented proof of full immunization against hepatitis B within         days of first being admitted to the seventh grade."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
